These Terms of Service ("Terms") govern your access to and use of Bruski's website, products, and services ("Services"). Please read these Terms carefully, and contact us if you have any questions. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.
1. Using Bruski
a. Who can use Bruski
You may use our Services only if you can form a binding contract with Bruski, and only in compliance with these Terms and all applicable laws. When you create your Bruski account, you must provide us with accurate and complete information. Any use or access by anyone under the age of 13 is prohibited.
b. Our license to you
Subject to these Terms and our policies (including our Community Guidelines), we grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services.
2. Your Content
a. Posting content
Bruski allows you to post content, including photos, comments, links, and other materials. Anything that you post or otherwise make available on our Services is referred to as "User Content." You retain all rights in, and are solely responsible for, the User Content you post to Bruski.
b. How Bruski and other users can use your content
You grant Bruski and its users a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, store, display, reproduce, save, modify, create derivative works, perform, and distribute your User Content on Bruski solely for the purposes of operating, developing, providing, and using the Bruski Services.
c. How long we keep your content
Following termination or deactivation of your account, or if you remove any User Content from Bruski, we may retain your User Content for a commercially reasonable period of time for backup, archival, or audit purposes. Furthermore, Bruski and its users may retain and continue to use, store, display, reproduce, modify, create derivative works, perform, and distribute any of your User Content that other users have stored or shared through Bruski.
3. Bruski Rights
All rights, title, and interest in and to the Services (excluding User Content) are and will remain the exclusive property of Bruski and its licensors. Nothing in the Terms gives you a right to use the Bruski name or any of the Bruski trademarks, logos, domain names, and other distinctive brand features. Any feedback, comments, or suggestions you may provide regarding Bruski or the Services is entirely voluntary and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you.
4. Privacy
Our Privacy Policy describes how we handle the information you provide to us when you use our Services. You understand that through your use of the Services you consent to the collection and use (as set forth in the Privacy Policy) of this information.
5. Security
We care about the security of our users. While we work to protect the security of your content and account, Bruski cannot guarantee that unauthorized third parties will not be able to defeat our security measures. Please notify us immediately of any compromise or unauthorized use of your account.
6. Termination
Bruski may terminate or suspend this license at any time, with or without cause or notice to you. Upon termination, you continue to be bound by Sections 2 and 3 of these Terms.
7. Disclaimers
Our Services are provided "as is." Bruski and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement. Neither Bruski nor its suppliers and licensors make any warranty that the Services will be error-free or that access thereto will be continuous or uninterrupted.
8. Limitation of Liability
In no event will Bruski, or its suppliers or licensors, be liable with respect to any subject matter of these terms under any contract, negligence, strict liability, or other legal or equitable theory for: (i) any special, incidental, or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees
